FreshUp Wallet Terms and Conditions
These Terms and Conditions (hereinafter referred to as "these Terms") are formulated by Fresh Up Group Limited (hereinafter referred to as "FreshUp" or "the Company") to regulate the registration and use of various services of FreshUp Wallet (hereinafter referred to as "FreshUp Wallet" or "the Wallet"). Please read and understand these Terms carefully. By successfully registering, topping up, or using the Wallet, you are deemed to have read, understood, and agreed to be bound by these Terms.
1. Account Registration and Security
1. Eligibility: FreshUp Wallet is operated and managed by FreshUp. Users must register using a valid Hong Kong mobile phone number through the Company's designated official channels (including but not limited to FreshUp AI Smart Vending Machines, the FreshUp Web App, or the App) and complete the registration process to use the service.
2. Accuracy of Information: Users must guarantee that the personal information provided is true and accurate. The Company shall not be held responsible if the balance cannot be recovered or notifications cannot be received due to incorrect information.
3. Account Security: Users bear full responsibility for the security and confidentiality of their accounts, passwords, and all login credentials. Any operation performed using the correct account and credentials, whether by the user or not, will be regarded as a valid action by the user. The user shall bear the relevant legal consequences and transaction liabilities. Unless explicitly prohibited by law, the Company is not liable for any losses resulting from the user's failure to properly safeguard account information. If a mobile phone is lost or an account is misappropriated, the user should immediately contact the Customer Service Center to apply for suspension.
2. Basic Functions and Payment Process

Top-up Function: Users can top up their FreshUp Wallet through designated payment platforms.

Shopping Payment: Users can choose to use their FreshUp Wallet balance to settle payments when shopping at FreshUp AI Smart Fridge.

Shopping Workflow:

The user scans the QR code on the FreshUp AI Smart Fridge and enters the FreshUp Web App.

Select "FreshUp Wallet" as the payment option (for top-up and balance details, please refer to Section 3, "Top-up and Balance").

After selecting items and closing the machine door, the system will automatically sense the products and complete the checkout.

The transaction amount will be automatically deducted from the user's FreshUp Wallet balance.
3. Top-up and Balance

Top-up Methods: Users can top up via designated third-party platforms (including but not limited to AlipayHK, WeChat Pay, Credit Cards, etc.).

Top-up Amounts: Users can choose fixed amounts of HK$50, HK$100, or HK$200.

Validity: Wallet balances generally do not expire (except for rewards/bonus credits from specific promotions, which follow the validity rules of the respective event).

Transaction Deduction: Upon completion of a transaction, the system will automatically deduct the corresponding amount from the balance.

Nature of Balance: The balance is currently only applicable for consumption at FreshUp AI Smart Fridges. FreshUp reserves the right to expand the scope of use in the future (to be announced separately) and the balance is non-transferable to other users.

Negative Balance: If a balance becomes negative due to any reason (e.g., system delay), the account will be immediately frozen. The user must settle the difference to restore service. FreshUp reserves the right to take legal action for long-term outstanding debts, suspend all functions, and restrict re-registration.
4. Transaction Discrepancies and Disputes

Appeal Time Limit: Due to the real-time nature of AI sensing technology, any objections regarding charges or items must be submitted via the Web App or customer service channels provided on the vending machine within 24 hours of the transaction.

Final Decision: FreshUp will verify claims based on back-end system records and monitoring footage. FreshUp reserves the right of final decision on all transaction disputes.
5. Balance Refund Policy

Application Procedure: Users have the right to apply for a refund of the "actual top-up balance" (excluding any gifted points, rewards, or coupons). Applications must be submitted via the designated interface in the Web App; identification documents may be required for verification.

Processing Time and Fees: Applications will be processed within 7-14 working days after receiving complete information. The Company reserves the right to charge a reasonable administrative fee for each refund (disclosed at the time of application), which will be deducted from the refund amount.

Refund Channels: Refunds will be issued via designated methods (e.g., back to the original payment tool or via bank transfer), determined by the Company based on internal policy and technical feasibility.

Final Authority: The Company reserves the final right to approve or reject any refund application, especially regarding accounts involved in suspicious or fraudulent transactions.
6. Disclaimer

Account Safety: FreshUp is not responsible for losses caused by user negligence leading to account theft.

Third-party Services: Top-up functions rely on third-party providers. Disputes regarding payment failure or duplicate charges must be resolved between the user and the provider. The Company acts only as a technical interface and is not liable for third-party service issues, though it will assist in referrals where possible.

System Maintenance: FreshUp is not liable for transaction failures or delays caused by network failures, power outages, or hardware malfunctions of AI sensors.

Suspension and Termination: FreshUp may suspend or terminate accounts for violations of these Terms, fraud, or security risks, and reserves the right to pursue legal action.

Limitation of Liability: To the maximum extent permitted by law, FreshUp disclaims all warranties. The Company is not liable for indirect or consequential losses. Total liability for any single event shall not exceed the transaction amount or HK$100, whichever is higher.
Personal Data Collection Statement

Purpose: Your phone number and transaction records are used for identity verification, customer service, and legal compliance.

Data Protection: All data is handled in accordance with the Personal Data (Privacy) Ordinance (Cap. 486) of Hong Kong.

Access/Correction: Users may access or modify their personal data via the Web App or by contacting customer service.
Amendments to Terms

Right to Amend: FreshUp reserves the right to amend these Terms at any time. Amendments take effect upon publication on the official website or Web App.

Language: These Terms are written in Traditional Chinese. In the event of any discrepancy between the Chinese version and any English translation, the Traditional Chinese version shall prevail.
